AUCTION TERMS & CONDITIONS

 

PROCEDURE:  The property will be offered in 3 individual tracts, in combination, or as a total of 42+/- acre unit.  Any qualified bidder may bid on individual tracts, combinations, and the total property.  The property will be sold in the manner resulting in the highest total price.

 

ACCEPTANCE OF BID PRICE:  All successful bidders will sign a purchase agreement at the auction site immediately following the close of bidding.

 

REAL ESTATE TAXES:  Seller agrees to pro-rate taxes for 2010 based on closing day.  All taxes thereafter shall be the responsibility of the buyer. 

 

POSSESSION:  All tracts day of closing.

 

EASEMENTS:  Sale of property is subject to any and all easements, recorded or unrecorded, visual or non-visual.

 

AGENCY:  Robert L. Blackford and its representatives are exclusive agents of the sellers.

Blackford Real Estate and Auction Company 15% of the final contract price as a non-refundable escrow deposit via cash, certified funds, cashiers check, or pre-approved personal check.  Personal or business checks should be accompanied by a bank letter of guarantee stating the account is in good standing with the bank and to what amount they will honor.  Your bidding is not conditional upon financing or appraisals, so be sure you have arranged financing, if needed, prior to bidding and are capable of paying cash at closing.  Vehicles & Personal Property – cash day of auction – vehicle titles will be mailed.

 

If a successful bidder fails to close within the time specified, sellers shall have the right to terminate the purchase agreement and retain the deposit as liquidated damages in addition to other legal remedies or at seller’s option, extend the closing past the designated closing date.
